01 Privacy Policy

1.1 Data We Collect
We collect personal data you voluntarily provide through our contact forms, including your name, email address, and project details. We also collect standard web analytics data (page views, session duration, referrer information) through essential cookies necessary for site operation.
1.2 Purpose of Processing
Your data is processed exclusively for: (a) responding to your service inquiries, (b) delivering requested technical services, (c) maintaining service quality and security, and (d) complying with legal obligations under applicable Romanian and EU data protection laws.
1.3 Legal Basis
Processing is conducted under Article 6(1)(b) of the GDPR (contractual necessity) for service delivery, and Article 6(1)(f) (legitimate interest) for site security and analytics. Where consent is required, it is obtained explicitly and can be withdrawn at any time.
1.4 Data Retention
Personal data is retained for the duration necessary to fulfill the purpose for which it was collected, or up to 24 months after the last interaction, whichever is sooner. Analytics data is aggregated and anonymized after 12 months.
1.5 Data Sharing
We do not sell or share personal data with third parties except: (a) service providers essential to our operations (hosting, payment processing) bound by data processing agreements, (b) legal authorities when required by law, and (c) with your explicit consent.
1.6 Your Rights
Under the GDPR, you have the right to: access your data, rectify inaccurate data, request erasure ("right to be forgotten"), restrict processing, data portability, and object to processing. Exercise these rights by contacting [email protected].
1.7 International Transfers
Data is primarily processed within the European Economic Area (EEA). Any transfer outside the EEA is conducted under Standard Contractual Clauses (SCCs) or equivalent safeguards as required by the GDPR.
02 Terms of Service

2.1 Scope of Services
TechHarborLabs provides web development, SaaS platform engineering, cloud infrastructure, and related digital services. Each engagement is governed by a specific service agreement outlining deliverables, timelines, and pricing.
2.2 Service Agreements
All projects begin with a written service agreement defining scope, milestones, acceptance criteria, and payment schedules. Changes to project scope require written approval and may affect pricing and timelines.
2.3 Intellectual Property
Upon full payment, all deliverables and associated intellectual property rights are transferred to the client. TechHarborLabs retains the right to display anonymized case studies and portfolio pieces unless explicitly restricted in the service agreement.
2.4 Payment Terms
Invoices are issued per the payment schedule in the service agreement. Standard payment terms are Net 15 days. Late payments accrue a 1.5% monthly administrative fee. All prices are quoted in USD unless otherwise specified.
2.5 Limitation of Liability
TechHarborLabs liability is limited to the total fees paid under the relevant service agreement. We are not liable for indirect, incidental, or consequential damages, including lost profits, data loss, or business interruption.
2.6 Confidentiality
Both parties agree to maintain confidentiality of proprietary information shared during the engagement. This obligation survives termination of the service agreement for a period of 36 months.
2.7 Termination
Either party may terminate with 30 days written notice. Work completed and approved prior to termination is payable in full. Undelivered milestones are not charged upon termination for convenience.
04 Refund Policy

4.1 Eligibility
Refund requests are evaluated based on the project phase and deliverables completed. Services that have begun execution are subject to partial reimbursement proportional to work completed.
4.2 Pre-Execution Refund
If a project is cancelled before any work has commenced, a full refund of any advance payment will be issued within 10 business days, minus any applicable transaction fees.
4.3 Partial Refund
If a project is cancelled mid-execution, reimbursement is calculated based on completed milestones versus total project scope. Uncompleted milestone payments are refunded in full.
4.4 No Refund Scenarios
Refunds are not available for: (a) completed and client-approved deliverables, (b) third-party software licenses procured on the client's behalf, (c) domain registration or hosting fees, and (d) consultation sessions already delivered.
4.5 Refund Process
To request a refund, contact [email protected] with your project reference and reason for the request. We will respond within 5 business days with a resolution or request for additional information.
4.6 Dispute Resolution
Any disputes arising from this policy will be resolved through good-faith negotiation. If unresolved, disputes are subject to the jurisdiction of the courts in Bucharest, România, in accordance with applicable Romanian law.
